Introduction

Attune Insurance Services, LLC™, (Attune, “we” or “us”) formerly known as NHT3 Insurance Services, LLC (NHT3), is a Delaware-domiciled limited liability company conducting business as an insurance producer, licensed in all 50 states and the District of Columbia. Trademarks and Copyrights

Attune’s name, logo and all related names, logos, product and service names, designs and slogans are trademarks of Attune Insurance Services, LLC or its parent company or its licensor.  All other names, logos, product and service names, designs and slogans on this Website are the trademarks or service marks of their respective owners. The word marks “Attune Insurance Services, LLC”, “Attune Insurance”, MyAttune” and “Attune” (in any font size or color) as they may appear alone or in conjunction with the following symbol are trademarks of Attune Insurance Services, LLC and may not be copied, duplicated or used for commercial purposes without express written permission. Nothing contained on this website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on this website without the written permission of Attune. Attune’s Business

Attune is a licensed property/casualty insurance producer. We principally act as an agent for insurance companies, while dealing fairly and in good faith and integrity with policyholders, other producers and business partners. For some insurance products, Attune may act as a licensed surplus lines producer with authority from an eligible surplus lines insurer. Attune maintains insurance producer and surplus lines insurance producer licenses in all 50 states and the District of Columbia.

Attune represents insurance companies in the solicitation and sale of insurance products, but currently is not a Managing General Agent (MGA) for any insurer as that term is defined in state insurance laws. Most of Attune’s business is generated from retail brokers (often called sub-producers) who represent insured clients. In some transactions, intermediary producers may be involved.  

Attune owns and maintains MyAttuneTM, a proprietary on-line portal that may be accessed by licensed producers having a producer contract with or other permission from Attune. Access may be through the “Broker Log-in” function of this Website or independently from the producer’s location. Access to and use of MyAttune permits producers to make submissions and complete insurance transactions with Attune on behalf of their clients. Access to MyAttune is not a grant of binding or underwriting authority and is not intended to create an agency relationship between Attune and the producer, but rather is an application of technology to effectuate insurance transactions. Authority granted by Attune, if any, is limited by the terms of the producer contract.  

Attune maintains a Customer Care Center for the purpose of providing assistance to producers and other third parties by responding to business inquiries and assisting with insurance transactions not completed through MyAttune.

Attune does not accept claim notices or service of legal process on behalf of the insurance companies it represents, nor does it adjust claims. When a claim is made, notice should be given to the insurance company, which is responsible for determining the parties’ rights and obligations under the insurance policies issued. Instructions for filing a claim are typically included with the policy. In some cases, the insurance company may be represented by a claim service company. Attune is not a claim service company.

Any descriptions of insurance products or services by Attune do not amend, modify or supplement any insurance policy. Policyholders should consult the actual policy and their insurance agent or broker for details regarding terms, conditions, coverage and exclusions in the policy, as well as products, services and programs which may be available. Eligibility for particular products and services is subject to the final determination of underwriting qualifications. Not all policies and/or coverages are available in every jurisdiction.

Whether coverage exists or does not exist for any particular claim or loss under any policy depends on the facts and circumstances involved in the claim or loss, the law applicable to the claim and all applicable policy wording. Any informational statements regarding insurance coverage, either in this web site or other Attune material, are for general description purposes only.

The general information contained in this Website is not an offer to sell insurance. No binder, insurance policy, change, addition, and/or deletion to insurance coverage goes into effect until the policy is issued and premium is paid. Any proposal of insurance Attune may present will be based upon the information the applicant provides. Information provided on this site does not constitute professional advice. Compensation

Attune is committed to dealing fairly and with complete integrity with consumers, other insurance producers and others with whom we work in providing insurance products and services. To that end, we provide this disclosure regarding Attune’s sources of its compensation from insurance companies or other parties.

Attune may receive compensation in the form of commissions paid by an insurance company, calculated as a percentage of premiums, pursuant to an arrangement with the insurance company. These commissions are for the service we perform in placing and servicing insurance policies on the insurance company’s behalf.

Attune may also be eligible to receive other forms of compensation such as incentive or contingency payments or bonuses and/or supplemental commissions from insurance companies. These may be based on our aggregate historical or current performance with respect to a line of business or customer segment and not specifically related to any particular policy or policyholder.

Other insurance producers who perform service in placing and servicing insurance through Attune may receive compensation from Attune in the form of service fees as determined by Attune’s arrangement with such producer.

Attune may hold premium or return premium funds temporarily, in which case Attune may receive interest or investment income on such funds.

Attune Insurance Services, LLC respects your privacy and is committed to protecting it through compliance with this policy.

The principal purposes of the Website are to introduce the public to Attune, describe our products and services, invite applications for employment and facilitate interaction with potential business partners. Currently, we do not collect information from you when you visit the website www.attuneinsurance.com (the “Website”).

From the Website, through the “broker sign-in” link, insurance producers may link to MyAttune, Attune’s on-line portal for making submissions to underwrite insurance business and complete insurance transactions. This is not a public website. In order to access MyAttune, a producer must have an in-force producer contract with Attune and must have current user names and passwords.

Information collected by us through MyAttune transactions, offline or through any other means, are subject to Attune’s data privacy and security and record retention policies.

The insurance producers, insurance companies and other third parties with which Attune conducts business are responsible for the efficacy of their own privacy and data security policies in protecting the privacy of their customers, employees, business partners and those visiting their websites.

Information provided by job applicants through Attune’s “Careers” page will be held in confidence and not disclosed to any third parties unless required by law. Such information will be used only for the purpose of evaluating the qualifications of job applicants.

Governing Law and Jurisdiction

At Attune’s sole discretion, we may require you to submit any disputes arising from the use of the Website or these Terms of Use, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying New York law.

Waiver and Severability

No waiver by Attune of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Attune to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

These Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and Attune Insurance Services, LLC with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

This notice will provide you with more detail about how we do that, and how we comply with the laws that protect your information under the Gramm-Leach-Bliley Act. Protecting Your Information

We are committed to protecting and maintaining the privacy of all of your information in our possession. We do this by having established internal policies and procedures that clearly outline proper handling and maintenance of the non-public personal information of our policyholders. These include, but are not limited to, policies related to the transmission, storage and disposal of paper and electronic information; the prevention of unauthorized access and damage to systems, including damage due to environmental hazards; and assigning and terminating user IDs.  We ensure that all Attune employees are trained on these policies and any updates to the policies are communicated on a regular basis.

Collection and Use of Information

We may collect non-public personal information about our policyholders for use in the processing and evaluation of applications or eligibility for insurance, investigating a claim, and in connection with other activities relating to your insurance.  Non-public personal information includes financial information, employment-related information and medical information. Any information that Attune collects and/or receives is used by authorized company personnel solely for the purposes described above, and it may be integrated into our databases for statistical and audit purposes. Unless permitted by law, we will only collect information from sources other than our policyholders with proper authorization.

Disclosure of Information

We do not disclose any non-public personal information about our policyholders or former policyholders to anyone unless permitted by law or with proper authorization from the policyholder. We do not sell policyholder lists or other non-public personal information. As permitted by law, there are circumstances when we will disclose non-public personal information related to a claim investigation or other activities relating to your insurance policy without authorization to third parties or affiliates assisting us with these activities.

Some examples of the situations in which we may disclose non-public personal information include:

  • Insurers that provide reinsurance;
  • Attune or our carrier affiliated companies;
  • Regulatory agencies such as departments of insurance and accreditation organizations;
  • Courts or attorneys who serve us with a subpoena;
  • Successor program or claim administrators;
  • Companies that assist Attune in recovering overpayments, paying claims or performing utilization review services;
  • Other companies not affiliated with Attune that provide services to us when disclosure is permitted, not prohibited or otherwise required by applicable law.

We may change these policies, standards and procedures at any time. If there are material changes, we will notify our insureds of the changes.

California Consumer Privacy Act Notice

This Consumer Privacy Notice (“Notice”) is provided on behalf of Attune Insurance Services, LLC (referred to hereinafter as “Attune,” “we” or “our”).  We are providing this Notice in accordance with our obligations under applicable law and as part of our commitment to handling your personal information responsibly and transparently.  Please review this Notice to understand our privacy practices, including what personal information we collect, why we collect it, how we collect it, and how you can exercise your rights with respect to your personal information.

This Notice applies to individuals associated with corporations, partnerships, other non-individual clients, and other non-client individuals who are California residents and whose personal information Attune collects. We refer to any company that is not part of Attune as a non-affiliated third party.

1.    What Personal Information Does Attune Collect?

The type of personal information we collect may vary depending on your relationship with us.  We may have collected the following categories of personal information:

  1. Identifiers, such as name, contact information, online identifiers and Social Security numbers and other government-issued ID numbers;
  2. Personal information, as defined in the California customer records law, such as insurance policy number, education, employment, employment history and financial information;
  3. Characteristics of protected classifications under California or federal law, such as sex, age, race, religion, national origin, disability, medical conditions and information, citizenship, immigration status and marital status;
  4. Commercial information, such as transaction information and history;
  5. Internet or network activity information, to the extent you visit our websites or use our software applications, such as browsing history and interactions with our and other websites and systems;
  6. Geolocation data, to the extent you access our website and choose to share your device geolocation data;
  7. Audio, electronic, visual, and similar information, such as recordings of calls to our representatives and call centers;
  8. Professional or employment-related information, such as work history, prior employer, information relating to references, details of qualifications, skills and experience, human resources data, and data necessary for benefits and related administration services; and
  9. Inferences drawn from any of the personal information listed above to create a profile or summary about, for example, an individual’s preferences and characteristics.

2. What Are Attune’s Sources of Personal Information?We collect the personal information described above directly from you such as through your transactions with Attune and our business partners, and your interactions with us on our websites and social media pages. We also collect this personal information from other categories of sources such as publicly available databases, consumer reporting agencies, commercially available sources, third parties authorized by you and prior and current employers, when they share the information with us.

3. How Does Attune Use Personal Information?Depending on your relationship with us, we may use the personal Information described above for the following purposes:

  • to operate, manage, and maintain our business, such as to make insurance decisions, communicate with you and others as part of our business, provide our products and services, and maintain records;
  • to develop and improve our products and services, such as to undertake quality and safety assurance measures, audit customer interactions, facilitate social sharing functionality, resolve complaints, and evaluate customer service;
  • for our employment and vendor management purposes;
  • for security purposes, such as to maintain our facilities and infrastructure, protect against malicious, deceptive, or fraudulent activity, and conduct internal investigations;
  • for monitoring purposes, such as to establish the existence of facts, maintain compliance with regulatory or self-regulatory practices, or for other purposes permissible under applicable law;
  • to perform other necessary and appropriate internal functions, such as accounting and auditing;
  • to conduct research, analytics, and data analysis, and for marketing purposes, such as to personalize, advertise, and market our products and services and administer contests and promotions, in accordance with applicable law; and
  • to comply with legal and regulatory requirements, defend legal claims, and assist with legal processes such as investigations, and regulatory requests, litigation, and arbitration.

4. How Does Attune Share Personal Information?Due to the size and complexity of our operations, we cannot identify every recipient of your personal information.  Depending on your relationship with us, we may share your personal information for the purposes described in Section 3 with the following categories of recipients: insurance and distribution parties; service providers; providers of Internet-connected devices and associated software; governmental authorities and third parties involved in court action; parties to a merger or acquisition; and our business partners or other third parties as may be required and where we have obtained the appropriate authorization.

The following categories of personal information may have been disclosed as described above:

When we share personal information with a non-affiliated third party, that third party cannot use the information except to perform services for Attune, or as may be permitted or required by law.  

We do not sell personal information.

5. What Rights Are Available

If you are a California resident and this Notice applies to you, you may request that we:

1. Disclose to you the following information covering the 12 months preceding your request:

  1. The categories of personal information we collected about you and the categories of sources from which we collected such personal information;
  2. The specific pieces of personal Information we collected about you;
  3. The business or commercial purpose for collecting personal information about you;
  4. The categories of personal information about you that we otherwise shared or disclosed, and the categories of third parties with whom we shared or to whom we disclosed such personal information (if applicable).

2. Delete certain personal information we collected from you.  In the event that you choose to exercise this right, please note that we may nevertheless retain your personal information as permitted under applicable law, including but not limited to the following purposes:

  1. To provide goods or services within the context of our relationship with you;
  2. To detect security incidents or other fraudulent or illegal activity;
  3. To comply with Attune’s legal and regulatory obligations; and
  4. To enable other uses that are compatible with your expectations or appropriate given the context in which the personal information was collected.

To submit a verifiable request, we will require that you or your authorized representative provide certain identifying information.  Authorized representatives will also be required to provide proof of their authority to act on your behalf. If we are unable to verify your identity, or confirm that you have authorized the request, we may not be able to respond to your request in full.

Under California law, you are entitled to exercise your rights without experiencing any discriminatory treatment.

We may change or update this CCPA Notice from time to time.  When we do, we will post the revised CCPA Notice on this page with a new “Last Updated” date.
